Lewis P Reid: CENG>Court> There was a explosion on planet and ship sensors detected it. I was sent down along with Lieutenant Greathouse and some of his infantry men to investigate. the Lieutenant was team leader.
Cylde Greathouse: MCO>::Listens::
Robert Devoroh: JAG> Can you tell us what was going on when Lt. Greathouse fired his weapon?
Lewis P Reid: As we investigated we found a small Andorian child. She wondered
Lewis P Reid: out into the wreckage. She was followed by three hostiles. Two were
Lewis P Reid: stunned and one lagged behind. Lieutenent Greathouse gave the man
Lewis P Reid: three warnings while I held the girl behind. The man leveled his
Lewis P Reid: weapon on the girl and Greathouse unloaded.
Cylde Greathouse: Sandra>::wrings her hands::
Lewis P Reid: All the shots fired by Greathouse and his marines were stun shots till the last.
Robert Devoroh: JAG> are you familier with the term ROE? Or Rules of Engagement?
AidanMcKenzie UF: Aidan> ::he noted the commander ignored him, as did the other woman he was looking at. He frowned a little, returning his attention firmly back to the trial::
Lewis P Reid: CENG> Aye sir, everyone who had been through 'war college' is familar with the 'Rules of Engagement'.
Robert Devoroh: JAG> can you describe to us what ROE states about how to engage this situation
Cylde Greathouse: Sandra>Holds her breath a second when reid asy unloaded::
Cylde Greathouse: MCO>::listens and knows this must be hard for his Sister::
Lewis P Reid: CENG> In this situation the rules of engagement are clear: One
Lewis P Reid: should only engage the enemy in like terms. One does not initiate
Lewis P Reid: hostile actions unless such actions are taken by the enemy. Once
Lewis P Reid: engage if the enemy has proven use of deadly action then one should
Lewis P Reid: respond in kind for one should never give the enemy more than one
Lewis P Reid: chance to kill you.
Robert Devoroh: JAG> Do you feel that Lt. Greathouse followed ROE?
Cylde Greathouse: MCO> ::Looks at the Judges to try and see a reaction::
Cylde Greathouse: Sandra>:;wtaches and listens, how her hands are held it looks like she's praying::
Lewis P Reid: CENG> I feel he did. The hostile would have certainly killed the child.
Robert Devoroh: JAG> just two more questions Lt. Ried; how long have you known Lt. Greathouse?
Lewis P Reid: CENG> All total, less then six months this is my first service and am newly assigned to Aryes.
Robert Devoroh: JAG> in the months that you've known Lt. Greathouse, has he ever deminstrated a willingness to murder anyone?
Cylde Greathouse: MCO>:;thinks back to Reid joind the ship::
Lewis P Reid: CENG> Not in the least. He's been more the kind and gentle type than anything.
Robert Devoroh: JAG>CENG> Thank you Lt. Reid, however please stay seated so that the prosecuter may cross examine you
Cylde Greathouse: Sandra>::smiles:: that's my baby brother ::she mutters::
ST NPC01: J1>CENG>Lieutenant Reid, in you 6 months with teh Aryes, have you ever seen Lieutenant Greathouse fire on another person, or act with viloence in his position as a Marine?
Cylde Greathouse: MCO>::sits wanting to smile but dosen't::
Lewis P Reid: CENG> Only in the normal capacity that A marine or marine commandant would
ST NPC01: J1>CENG But you have seem him committ violence, so it obvious that he is capable of such acts. I mean a Marine unwilling to combat would be an almost obsurd possibility, am I correct?
Cylde Greathouse: Sandra>::gasps at the question::
Lewis P Reid: CENG> Yes and no. Marines are trained to violence, but as
Lewis P Reid: peacekeepers such is within their. They are trained to kill but only
Lewis P Reid: when the order or situation merits. Marines are mindless killers.
Lewis P Reid: Because their is so much potential for violence in their training they
Lewis P Reid: are also trained to always be in control.
Inid Kiara: Hops> ::thinks that she has a problem with the last question. Shes seen body guards do more damage then a Marine. What was the point to that question::
Lewis P Reid: *are noe
Lewis P Reid: *are not
Cylde Greathouse: MCO>::wants to speak up but dosen't::
ST NPC01: J1>CENG>But they are capable. ::he runs through a PADD and looks something.:: Lt. Knightner, spoke of the ROE.
ST NPC01: Starfleet Rules of Engagement say that all weaponry must remain on stun unless, in a time of war, under extreme circumstances,
ST NPC01: or otherwise ordered to do so by a ship's commanding officer or an officer of equal or higher rank. Did you know that?
AidanMcKenzie UF: Aidan> ::As he sat listening, he thought to himself, anyone willingly pointing a weapon at a child, of any race, is a extreme circumstance in his opinion::
Cylde Greathouse: MCO>::Thinks extreme circumstance were meet still wonders how his phaser got off of stun::
Lewis P Reid: CENG>J1Actually I did sir, but starfleet regulations always leave
Lewis P Reid: some room for the situation because as my academy instructor always
Lewis P Reid: told me 'If they tried to account for every scenario in starfleet
Lewis P Reid: regs we'd still be writing them'. In this case military ROE can apply.
ST NPC01: J1>CENG>Yes or no will suffice, Lieutenant... You were present at the incident. In your opinon,
ST NPC01: would 1st Lieutenant Greathouse's objectives in preventing harm to this girl have been hindered if he only simply stunned the attacker in question, and not killed him.
ST NPC01: J1>CENG>Yes or No...
AidanMcKenzie UF: Aidan> ::he shook his head, muttering:: stun.. since when do weapons have a stun setting?
Lewis P Reid: CENG>J1> In my experience as both and engineer ane a weapons expert along with being there my answer is Yes, the would have been hindered.
ST NPC01: J1>CENG>So you are saying that he could not haven accomplished the exact same end with the stun setting than with the kill setting. Please explain... in your 6 months of experience
Cylde Greathouse: MCO>::listens to the testimony::
ST NPC01: have*
Inid Kiara: Hops> ::listens and shakes her head another Sgt Delgado incident.::
Cylde Greathouse: Sandra>::Copse her hands over her mouth::
Cylde Greathouse: cops
Lewis P Reid: CENG> He smiles broadly::J1> Gladly, if he had done as you wanted
Lewis P Reid: he would have had to have the weapon on the first stun setting
Lewis P Reid: ::turns and looks as the judges:: as you all know there are multiple
Lewis P Reid: stun settings on a starndard issue phaser. There was no garauntee
Lewis P Reid: that the first setting would have the desired effect of ending the
Lewis P Reid: threat. Should it not the hostile would have had his shot at the girl
Lewis P Reid: while Greathouse adjusted his setting.
AidanMcKenzie UF: Aidan> ::mutters:: only "stunning" the assailant he could have shot and killed the child and most likely other people as well
Inid Kiara: Judge3> ::listens to everything being said::
Cylde Greathouse: MCO>:: Listens and cheers in his head at reid::
Inid Kiara: Judge3> Did you as Ceng get a chance to check the weapon? And if it was set at Stun how would the setting change?
ST NPC01: J1>CENG>According to Greathouse's previously recorded statements he believed the phaser was set on stun, as my collegue just brought up. Do you know if that was the case?
Lewis P Reid: CENG>::Nods: Yes, he confirmed that they all checked weapons and his was on stun.
Lewis P Reid: CENG>:::Turns to the judges:: May I run a scenario by all of you?
ST NPC01: J1>CENG>please do.
Cylde Greathouse: MCO>::listens ::
Cylde Greathouse: Snadra>::listens as she worried its not sounding good so far::
Lewis P Reid: CENG> Put yourself in the position of the Lieutenant. The hostile
Lewis P Reid: was a man of gerth and greathouse being one himself knows that he
Lewis P Reid: can take a stunning blast or two and stay concious. Your weapon is
Lewis P Reid: on the first stun setting and you look into thie man's eyes and see
Lewis P Reid: that his only desire was to murder this child. I know I saw it. You
Lewis P Reid: know you have one shot and you Can't look down at your phaser to
Lewis P Reid: check settings while you are worning him you slide it up to the
Lewis P Reid: highest setting because you can only feel high and low by touch. You
Lewis P Reid: also know that should you not put the assailent down he's going to
Lewis P Reid: kill the girl. so you warm him not wanting to do it, but the man does
Lewis P Reid: not stop so you fire.
ST NPC01: J1>CENG>Interesting, So are you then suggesting that Lt. Greathouse dialed up his phaser to max before firing. He purposely raised the setting just before firing the weapon?
ST NPC01: J1>CENG>So he had a clear intent to kill?
Lewis P Reid: CENG>J1> I can't read minds, but it could have gone that way. I
Lewis P Reid: dont think there was ever a 'clear intent to kill' there was only the
Lewis P Reid: mission and keeping the girl safe which btw proved valuable because
Lewis P Reid: without the girl we woudlnt' have been able to stop the Andorians.
ST NPC01: J1>::He looks through his PADD again.::CENG> As a weapons expert, Did you know that the lowest stun setting failed on humaniods of a body mass of 300 kg or lower only .03% of the time.
ST NPC01: So are you suggesting that all personnel should set their phasers to kill just to "be sure?"
Lewis P Reid: CENG>J1>No and not every stunning scenario is one involving an innocent life.
AidanMcKenzie UF: Aidan> ::mutters:: hypothetical question..
Cylde Greathouse: Sandra>Clyde :;she mutters::
Cylde Greathouse: MCO>::Trys not to feel like its going bad::
Shran113: CO>::He puts his his fingers into his eys to clear them a minute. It was not going well.::
ST NPC01: J1>CENG>So in summation, Lieutenant, you believe that the regulations set down by Starfleet are in fact wrong, and Lieutenant Greathouse dialed up his own phaser before firing to kill his target, intentionally?
Robert Devoroh: JAG> Objection, leading question
Lewis P Reid: CENG>J1> I don't believe I used the word 'wrong' in my entire
Lewis P Reid: statement. I don't believe in going against regulation, but I also
Lewis P Reid: understand that the universe isn't run under lab conditions. Its one
Lewis P Reid: of the reasons I joined starfleet. If you are asking my if by 'the
Lewis P Reid: letter' of the rules Greathouse in violation the answer is yes, but
Lewis P Reid: the spirit of star fleet and the federation of planets is to preserve
Lewis P Reid: life. he did that. Punish him for not following the rules but dont'
Lewis P Reid: lose a great officer who defended the weak and saved a life to
Lewis P Reid: placate a politica ally.
ST NPC01: J1>::He nods.::CENG>Thank you Lieutenant JG Ried. You may step down.

Cylde Greathouse: Sandra>::wrings her hands::
Cylde Greathouse: MCO>::listens ::
Cylde Greathouse: Sandra>Clyde :;she mutters::
